1. General Provisions
1.1 This Privacy Policy (hereinafter - the "Policy") is regulated by the Constitution of the Russian Federation, Federal Law "On Information, Information Technologies and Information Security" # 149-FZ dated July 27, 2006, Federal Law "On Personal Data" #152-FZ dated July 27, 2006 and other regulations.

1.2 Main definitions used in these Regulations:

SELLER / OPERATOR - A.I. Gorelov (INN 772422807706 / OGRNIP 316774600073980).

ONLINE STORE is a website owned by the Seller located on the Internet at https://sayonara.store showing the Sellers’ Items for buying, as well as the terms of payment and delivery of the Items to the Buyers.

COOKIES are small pieces of data that enhance the effectiveness and provide a better browsing experience to the user. This information may include data about the Customer's location or language preferences, or about the items the Customer liked, which will be stored in user’s web browser when the Customer re-enters the Website.

CUSTOMER, a Site visitor, is a person who is browsing the site https://sayonara.store with no intention of placing an Order; User is an individual, a Site visitor, who accepts the terms of the Public Offer published on the site: https://sayonara.store, and has intentions of making an online purchase; BUYER is a User who has placed an Order in the online store; all above mentioned individuals are personal data subjects.

PERSONAL DATA is information, stored in any format, that relates to an identified or identifiable (based on such information) individual (personal data subject), which alone or in combination with other information available to the online store, allows the Customer to be identified.

PERSONAL DATA PROCESSING means actions (operations) with regard to personal data, including collecting, recording, systematizing, storing, modifying (updating, changing), retrieving, using, disclosing (including sharing), depersonalizing, blocking, destroying personal data.

DISSEMINATION OF PERSONAL DATA means any actions aimed at disclosure of personal data to an indefinite range of persons (transfer of personal data) or to make personal data available to an unlimited range of persons, including disclosure of personal data in the media, placement in information and telecommunications networks or providing access to personal data in any other way.

USE OF PERSONAL DATA means actions (operations) with regard to personal data performed by the operator for the purpose of making decisions or performing other actions that have legal consequences with respect to the personal data subject or other persons or otherwise affect the rights and freedoms of the personal data or other persons.

PERSONAL DATA CONFIDENTIALITY is the mandatory requirement for the Operator, or other entity with access to personal data, to ensure that such data is not disclosed without permission of the data subject or on other legal grounds.

1.3. These Regulations establish the procedure for processing Customers’ personal data when selling them Items.
1.4 The purpose of these Regulations is to ensure the protection of human and civil rights and freedoms while processing their personal data.
1.5 Personal data is processed for the purposes for which it was submitted, including: identification of the Site Visitor, registering in the self-service system (personal account), creating a feedback system, including sending notices, requests for services, processing requests and applications from the Site Visitor, tracking the Site Visitor’s location to ensure security, fraud prevention, and for other purposes in accordance with the Seller’s accepted Public Offer published on the online store platform (one party to the Public offer is a Customer) or with the consent of the Site Visitor. 1.6 Personal data shall not be used to cause material or moral harm to citizens or to impede the exercise of the rights and freedoms of citizens of the Russian Federation.
1.7 These Regulations shall be approved by the Director and shall be binding on all employees who have access to the Customer's personal data.

2. Customer personal data content and data collection
2.1. Personal data collected and processed by the Online store includes: personal data (name, first name); residence address; e-mail address; contact phone number, as well as the information provided by the User himself/herself when registering a personal account, when placing an online order or while browsing the Site.
2.2. The Seller’s employees shall collect all personal data directly from the personal data subject, i.e., Customers.
2.3. Consent to personal data processing shall be considered valid if the Customer activates a tick box of the consent form posted on the Site giving consent to personal data processing to the extent, for the purposes and in the manner, stipulated in the text of the form prior to obtaining consent.

3. Processing and Storing of Customer Personal Data
3.1. Processing of personal data by the Online Store in the interests of Customers means receiving, systematizing, accumulating, storing, updating (refreshing, modification), use, distribution, anonymization, blocking, destruction and protection against unauthorized access to Customer personal data.
3.2. The Customer consent to the personal data processing is not required, as personal data is processed in order to execute the Public Offer, where one of the parties hereto is the Customer, i.e., the personal data subject.
3.3. The Customer personal data is processed by manual and automated means.
3.4. Customer personal data shall be accessed for processing solely by the Seller’s employees who have signed the Customer Personal Data Confidentiality Agreement.
3.5. The list of employees with access to the Customer personal data shall be approved by the Director’s Order.
3.6. The hard-copies containing Customer personal data shall be stored in the Seller’s safe, access to the hard-copies is granted solely to employees who have signed the confidentiality clause.
3.7. The Customers’ digital personal data is stored in the local computer network of the Online store, in electronic folders and files stored on a hard disc of the Seller’s personal computers, the computers of the Seller’s employees, authorized to process Customer personal data.

4. Use and Disclosure of Customer Personal Data 4.1. The Customer personal data used exclusively for the purposes defined by the Public Offer between the Customer and the Online store. 4.2. When collecting the Customer personal data, the online store shall comply with the following requirements: 4.2.1. To notify the personnel who collect the Customer personal data, that this data can be used only for the purposes it was submitted for, and to require these personnel to confirm that this rule has been followed. The personnel who collect the Customer personal data are obliged to respect the confidentiality. This provision does not apply to depersonalization of personal data and in respect of publicly available data.
4.2.2. To grant access to the Customer personal data only to specially authorized persons, such persons should have the right to collect only those personal details which are necessary for the performance of specific functions. 4.2.3. When transferring personal data across borders, the Online store is required to ensure that the rights of the personal data subjects are adequately protected by the foreign State in whose territory the personal data is transferred. 4.2.4. Cross-border transfer of personal data in the territory of foreign States, which do not provide adequate protection of the rights of personal data subjects, may be carried out in the following cases:
- the Customer’s written consent;
- in cases of international treaties of the Russian Federation on the issuance of visas, international treaties of the Russian Federation on the provision of legal assistance in civil, family and criminal cases, and international treaties of the Russian Federation on readmission;
- in cases provided by federal laws, if necessary, in order to protect the foundations of the constitutional order of the Russian Federation, to ensure the defense of the country and the security of the State;
- the execution of the contract to which the personal data subject is a party;
- to protect the life, health, other vital interests of the personal data subject or other persons if the written consent of the subject of personal data cannot be obtained.
4.3. Questions relating to the transmission of personal data by telephone or fax shall not be answered.

4.4. The online store has the right to provide or transmit the Customer personal data to third parties in the following cases:
- the customer has agreed to such actions;
- the transfer is necessary for the Customer to use a certain service or for the fulfillment of a certain agreement or contract with the Customer;
- transfer is necessary for the Site’s functioning and performance;
- if the disclosure of this information is required for compliance with the law, execution of a court act;
- to assist in investigations conducted by law enforcement or other State authorities;
- to protect the Customer’s rights and legitimate interests and the Online store.

5. Protection of Customer personal data from unauthorized access
5.1. The Online store is required, when processing the Customer personal data, to take the necessary organizational and technical measures to protect personal data from unauthorized or accidental access, destruction, modification, blocking, copying, dissemination of personal data, as well as from other unlawful actions.
5.2. In order to effectively protect Customer personal data, it is required to:
5.2.1. Comply with the procedure for obtaining, recording and storing Customer personal data;
5.2.2. Use technical means of security, alarm system;
5.2.3. Conclude a Personal Data Confidentiality Agreement with all employees involved in collecting, processing and protecting Customer Personal data;
5.2.4. Take disciplinary actions on employees who have violated the rules governing the collecting, processing and protection of Customer personal data.
5.3. Access to the Customer personal data by the Seller’s employees who do not have duly authorized access is prohibited.
5.4. Documents containing Customer personal data shall be kept on the Seller’s premises, providing protection against unauthorized access.
5.5. Protection of access to electronic databases containing Customer personal data shall be provided by:
- the use of licensed software products that prevent unauthorized access of third parties to the Customers personal data;

- password system. The passwords are set by the system administrator and communicated individually to the employees who have access to the Customer personal data.
5.6. Copying and making extracts of Customer personal data is allowed only for business purposes with the written permission of the Seller’s management.

6. Online Store Responsibilities 6.1. The online store undertakes: 6.1.1. To process the Customer Personal Data solely for the purpose of executing the Public Offer. 6.1.2. To receive the Customer Personal Data directly from the Customer. If the Customer Personal Data can be obtained only from a third party, the Client must be notified in advance and written consent must be received from them. The Seller’s employees must inform the Customers about the purposes, expected sources and ways of obtaining personal data, as well as about the nature of the personal data to be received and the consequences of the Client’s refusal to give a written consent to collect Personal Data. 6.1.3. Not to collect or process Customer Personal Data relating to his race, nationality, political opinions, religious or philosophical beliefs, state of health, intimate life, except as provided by law. 6.1.4. To provide the Customer or his legal representative with access to his personal data when addressing or receiving a request containing the number of the main document confirming the identity of the Customer or his legal representative, information on the date of issue of said document and the issuing authority and the signature of the Customer or his legal representative. The request may be sent electronically and signed with an electronic digital signature in accordance with the legislation of the Russian Federation. Information on the availability of personal data shall be provided to the Customer in an accessible form and shall not contain personal data relating to other subjects of personal data.
6.1.5. To limit the Customer’s right to access his personal data if: - personal data, including personal data, obtained as a result of operational search, counter-intelligence and intelligence activities, is processed for defense, national security and law enforcement purposes; - personal data is processed by the state authorities that have detained the personal data subject on suspicion of committing a crime or who have charged the personal data subject with an offence in a criminal case, or who imposed on the personal data subject pre-trial measures, except as provided for by the criminal procedural legislation of the Russian Federation, or if the suspect or defendant is allowed to obtain such personal data; - the provision of personal data violates the constitutional rights and freedoms of others. 6.1.6. To ensure the storage and protection of Customer Personal Data from its misuse or loss. 6.1.7. In case of revealing personal data inaccuracy or illegal handling of such by the operator when dealing with or at the request of the personal data subject or his legal representative or authorized body for the protection of the personal data subject’s rights, the operator must block personal data, relating to the relevant personal data subject, from the date of such a request or receipt of such a request for the entire inspection period. 6.1.8. If the fact of personal data inaccuracy has been confirmed, the operator on the basis of documents submitted by the personal data subject or his legal representative or by the authorized body for protection of the rights of personal data subjects, or other necessary documents must clarify personal data and lift off the block.
6.1.9. In case illegal personal data handling was detected the operator must remedy such violations within three business days from the date of violation detection. If remedy of the violations committed is impossible, the operator must destroy the personal data within three business days from the date of detecting the illegal actions with personal data. The operator is obliged to notify the personal data subject or its legal representative about the violation remedies or about the personal data destruction, as well as to notify an authorized body for the personal data subjects rights protection in case when the application or request was sent by said authority.

7. The Customer’s rights
7.1 The Customer has the right of:
- access to personal information held about him, including data containing information confirming the fact of personal data processing, as well as the purpose of such processing; methods of processing of personal data used by the Online store; information about personnel who have access to personal data or who may be granted such access; the list of processed personal data and the source of its receipt, the terms of processing of personal data, including the terms of storage; information on what legal consequences the processing of his personal data may entail for the Customer;
- defining forms and methods of processing of his personal data; restriction of methods and forms of processing of personal data; prohibition of distribution of personal data without his consent; change, clarification, destruction of information about himself.
The Customer has the right to modify and/or clarify his personal data by making changes to the personal data in a personal account on the site of the online store, using the feedback form.

8. Confidentiality of Customer personal data
8.1 Information about the Customer personal data is confidential.
8.2 The online store ensures the confidentiality of personal data and is obliged to prevent its dissemination to third parties without the Customer’s consent or without any other legitimate grounds.
8.3 Personnel with access to the Customers personal data shall be obliged to comply with the confidentiality policy, they must be aware of privacy requirements. In view of the personal data confidentiality policy, appropriate security measures must be provided to protect data from accidental or unauthorized destruction, from accidental loss, from unauthorized access to it, modification or dissemination.

8.5 The personal data confidentiality control is lifted off in case of depersonalization or if the Personal Data has been made public, unless otherwise defined by law.

9. Liability for breach of Customer personal data processing regulations
9.1 The Seller is responsible for the personal data in its possession and establishes personal responsibility of its employees for compliance with the established confidentiality policy.
9.2 Each Seller’s employee, who has obtained a document containing the Customer personal data for processing, is solely responsible for the safety of the carrier and the data confidentiality.
9.3 Any person is entitled to contact a Seller's employee with a complaint of violation of these Regulations. Data processing breaches complaints and applications shall be considered within three days from the date of submission.
9.4 The Seller's employees are obliged to ensure the proper handling of Customers' inquiries, applications and complaints, as well as assist in the execution of the requirements of the competent authorities.
9.5 Persons guilty of violating the regulations on the collection, processing and protection of the Customer personal data shall bear disciplinary, administrative, civil or criminal liability in accordance with the legislation of the Russian Federation.
9.6 The Seller has the right to alter the terms of the privacy policy unilaterally at any time.

Online Store - the official online store of the Seller IE Gorelov Aleksandr Ivanovich, located at the internet address https://sayonara.store presenting the Goods offered by the Seller for buying, as well as the terms of payment and delivery of the Goods to Buyers.
Goods - clothes, shoes, accessories and other goods presented for sale on the Site.
Order is a request duly executed and placed by the User, the Buyer (the relevant fields on the site in the section "Shopping Cart", "Payment order") for the purchase and delivery to the address specified by the User, the Buyer.

Acceptance - Buyer's order for the Goods under the terms of the Public offer.

1. General provisions
1.1. The seller sells the Goods via the Online Store at https://sayonara.store.
1.2. By ordering the Goods through the online store, the User agrees to the terms of sale of the Goods set out below (hereinafter - the Terms for the Sale of Goods). In case of disagreement with this Public Offer, the User shall immediately stop using the service and leave the https://sayonara.store site.
1.3. These Terms for the Sale of Goods, as well as the Goods information provided on the Site, shall be a public offer in accordance with. Art. 437, para. 2, of the Civil Code of the Russian Federation. Relations regarding consumer rights protection shall be governed by the Civil Code of the Russian Federation, the Law “On Consumer Rights Protection”, the Decree of the Government of the Russian Federation “On Approval of the Rules of Sale of goods remotely” and other federal laws and legal acts of the Russian Federation enacted thereof.

2. Subject matter
2.1. The subject matter of this Public offer is selling Goods presented in the catalogue of the Internet Store at https://sayonara.store to the User for personal, family, household and other needs, not related to business activities.
2.2. This Public Offer applies to all types of Goods and Services presented on the Site, as long as such offers with description are available in the catalogue of the Internet Store.

3. Goods and purchase procedure
3.1. The Seller is not responsible for the accuracy and correctness of the information provided by the User when placing the Order.
3.2. Communication of the User/ Buyer with managers and other Seller’s representatives should be governed by the principles of common morality and communication etiquette. The use of obscene words, profanity, abusive language, as well as threats and blackmail are strictly prohibited, regardless the form or addressee of this kind of language.
3.3. In case the Goods ordered by the Buyer are out of stock, the Seller has the right to exclude the specified Goods from the Order / cancel the Buyer's Order, notifying the Buyer by sending a relevant e-mail to the address specified by the Buyer in registration.

3.4. In case of cancellation of a fully prepaid Order, The Seller shall give the Buyer the refund by the same means as the payment was made.

3.6. The Buyer bears full responsibility for providing inaccurate data, which resulted in the Seller’s inability to properly perform any of its obligations to the Buyer.
3.7. The Goods delivery date may be changed unilaterally by the Seller due to objective reasons from the Seller’s perspective.
4. Delivery of the goods.

4.2. All goods presented in the catalogue of the online store at https://sayonara.store shall be purchased by the Buyer through the pre-order form.
4.3. After completing the checkout and upon payment all goods presented in the catalogue of the online store at https://sayonara.store, are transported to the delivery service within 1-2 working days.
4.2. The delivery of the Goods shown on the Site and sold by the Seller is not possible outside the Russian Federation.
4.3. The Seller makes every possible effort to meet the agreed delivery dates. The Seller is not responsible for possible delays in delivery due to unforeseen circumstances beyond the Seller's control.
4.4. Upon shipment the Order is handed to the Buyer or to a third person specified in the Order as the recipient (hereinafter the Buyer and the third person are referred to as the Recipient). If it is impossible to receive the Order by the abovementioned persons, the Order can be handed to the person who can provide information about the Order (the shipment number and/or the Recipient's name).
4.5. The risk of accidental destruction or accidental damage of the Goods passes to the Buyer from the moment of delivery of the Order and signing by the Order Recipient by the documents confirming delivery of the Order. In case of non-delivery of the Order, the Seller shall reimburse the Buyer the value of the Order paid by the Buyer and delivery in full upon receipt of confirmation of the loss of the Order.
4.6. The cost of delivery of each Order is calculated individually and depends on the chosen delivery method.
4.7. The User understands and agrees that: delivery is a separate service that is not an integral part of the Goods purchased by the Buyer. Claims to the quality of the purchased Goods arising after receipt and payment of the Goods shall be considered in accordance with the Law of the Russian Federation “On the protection of consumers’ rights” and warranty obligations of the corresponding Seller. Therefore, the purchase of the Goods by delivery does not give the Buyer the right to demand delivery of the Goods purchased for the purpose of warranty service or replacement, does not enable carrying out warranty service or replacement of the Goods by visiting the Buyer and does not imply the possibility of return of the cost of delivery of the Goods in cases where the Buyer is entitled to be returned the money paid for the Goods as such, in accordance with the Law of the Russian Federation from 07.02.1992 N 2300-1 “On Consumer Protection”.
4.8. The Seller’s obligation to hand over the goods to the Buyer is deemed to have been fulfilled at the moment of delivery of the Goods to the Recipient or receipt of the Goods by the Recipient at the post office/ at the place of issue of the orders.
4.9. Upon receipt of the Order from a transport company or postal service, the Recipient of the Goods is obliged to inspect the delivered Goods and open them in the presence of employees of the transport company or postal service, to check the Goods for compliance with the declared quantity, assortment and completeness of the Goods, as well as to check the integrity of the package. In case of claims to the delivered Goods (short-shipment, shipment of Goods other than those indicated in the packing sheet, industrial defect, other claims) The recipient shall, in the presence of the employees of the transport company or the postal service, draw up the Act on Detected Inconsistencies. If the Consignee has not made a claim in the above manner, the Seller shall be deemed to have fully and properly fulfilled his obligation to hand over the Goods.
4.10. In the event of the return of Goods delivered by means of a transport company or postal service, in connection with the existence of claims to the Goods the Recipient shall attach to the Shipment containing the returned Goods the following documents: Application for the return of funds; Copy of payment receipt; a copy of the packing sheet; a photograph showing the defect, the conclusion of an expert examination (if it was carried out).

5. Payment for goods
5.1. The price of goods sold in the online store is indicated in rubles of the Russian Federation. Payment is made to the accounts specified by the Seller.
5.2. The prices of the Goods shall be determined by the Seller unilaterally and without dispute and shall be indicated on the pages of the Online Store at https://sayonara.store. In the event of incorrect indication of the price of the Goods ordered by the Buyer, the Seller shall inform the Buyer of this fact in order to confirm the Order at the corrected price or to cancel the Order. If it is impossible to contact the Buyer, this Order shall be considered void, unless the price of the Goods has been reduced and/or proved to be lower than indicated on the pages of the Online Store. If the Order has been paid, the Seller shall return to the Buyer the amount paid for the Order in the same way as it was paid.
5.3. The price of the Goods on the Site may be changed unilaterally by the Seller. The price of the Goods ordered by the Buyer is not subject to change. A proposal to conclude a contract for a specific product is valid for as long as the goods remain on the Seller’s website, provided that the goods are available in the Seller’s warehouse.
5.3.1. The Buyer may pay in the following ways:

5.4. Special conditions of paying for the Goods with bank cards:
5.4.1. In accordance with the regulation of the Central Bank of the Russian Federation “About the issue of bank cards and transactions made using payment cards” from 24.12.2004 266-P transactions on bank cards are performed by the cardholder or an authorized person.
5.6. Authorization of bank card transactions is carried out by the bank. If the bank has reason to believe that the transaction is fraudulent, the bank has the right to refuse to carry out the transaction. Fraudulent transactions with bank cards fall under article 159 of the Criminal Code of the Russian Federation.
5.7. In order to avoid cases of various misuse of bank card payments, all Orders made on the Site and prepaid by a bank card are checked by the Seller.
5.10. When conducting marketing activities involving any marketable items included in the packaging with the Order of the Buyer, the delivery of said included items is carried out at the expense of the Buyer. In order to refuse such included item, the Buyer should contact the Seller through the section “Contacts”.
5.12. The Seller has the right to limit the payment methods available to the Buyer depending on the volume of previous orders.

6. Return and exchange of goods and refunds
6.1.1. Return of Goods sold by the Seller shall be made in accordance with the following return conditions.
6.1.2. The Buyer has the right to exchange Goods, if they do not satisfy the Buyer in form, dimensions, style, color, size or configuration within the exchange period - 7 days following the Buyer’s receipt of the goods.
6.1.3. Terms for goods return or exchange: goods must retain their original appearance, include the original packaging, seals, labels, retain consumer properties; the completeness of the goods shall be preserved, a document confirming the sale and buying terms for the specified item (sales slip or cash receipt).
6.2. Return of Acceptable Quality Goods
6.2.1. The Buyer shall have the right to refuse the ordered Goods at any time before receipt, and after receipt of the Goods - within 7 (Seven) days.
6.2.2. In case of refusal by the Buyer of the Goods, the Seller shall return to him the value of the Goods returned, except for the expenses of the Seller connected with delivery of the Goods returned by the User/ Buyer, within 10 (Ten) working days from the date of receipt of the returned Goods to the Seller’s warehouse together with the Buyer’s filled application for the return of cash.
6.2.3. If, at the time of the User’s/ Buyer’s application, the similar goods are not available from the Seller, the Buyer has the right to refuse the performance of this Public Offer and to demand the return of the money paid for said Goods. The Seller shall return the money paid for the returned goods within 10 (Ten) working days from the day of return of the Goods.
6.2.4. In order to return the Goods of acceptable quality (including due to the exchange of the Goods), the Customer undertakes to carefully pack the Goods (with all the contents and a complete set of accessories specified in the technical documentation on the Goods) and attach the following documents:
- Return Form;
- Copy of passport (or other identity document);
- Copy of the payment receipt.
6.3. Return of Defected Goods:
6.3.1. Defected goods item means a product that is defective and cannot ensure the performance of its functional qualities, does not meet the requirements specified in the creative assignment (when manufacturing goods to order). The Goods received should conform to the description on the Site. The difference between the design or design elements and the description stated on the Site is not a sign of defected quality.
6.3.2. The appearance and completeness of the Goods as well as the completeness of the entire Order shall be inspected by the Recipient at the time of delivery of the Goods.
6.3.3. When delivering the Goods, the Buyer shall sign the delivery receipt in the box: “I confirm receipt of the order, contents are complete and intact; I have no claims as to the quantity and appearance of the goods”, or in another similar document issued by the Seller, in the box providing for the Buyer to note that he has no claims to the completeness, quantity and quality of the Goods. After receipt of the Order, claims as to external defects of the goods, their quantity, completeness and appearance are not accepted.
6.3.4. If the Buyer has been given the Goods of unacceptable quality and the Seller has not stipulated otherwise, the Buyer is entitled to use the provisions of Article. 18 “Rights of the consumer when revealing defects in the product” of the Law of the Russian Federation from 07.02.1992 N 2300-1 “On the protection of consumers’ rights”.
6.3.5. Claims for refund of the money paid for the goods shall be satisfied within 10 (Ten) working days from the date of submission of the corresponding claim (art. 22 of the Law of the Russian Federation “On Consumer Protection”).
6.3.6. Refunds shall be made by returning the value of the paid Goods to the bank card indicated when ordering the Goods.
6.4. The return of the Goods is possible through any logistics service.
6.4.2. The goods are returned to the Seller at the expense of the Buyer.
6.4.3. The buyer sends the returned goods in a declared value parcel, without cash on delivery. Packages sent by cash on delivery are not accepted for return. The package must contain a completed return application form.

7. Responsibility
7.1. The Seller shall not be liable for damage caused to the Buyer due to improper use of the Goods purchased in the online store.
7.2. The Seller is not responsible for the accuracy and correctness of the information provided by the User during the registration or execution of the Order.

8. Protection of personal data
8.1. Personal data of the User/ Buyer are processed in accordance with the Federal Law “On Personal Data” No. 152-FZ.
8.2. When registering on the Site, the User provides the following information: surname, first name, patronymic, contact phone number, e-mail address, date of birth, gender, address of delivery of goods with the postcode of the city.
8.3. By providing your personal data to the Seller, the Site Visitor/ User/ Buyer agrees to their processing by the Seller, including for the purpose of fulfilling the Seller’s obligations to the Site Visitor/ User/ Buyer within this Public Offer, promotion by the Seller of goods and services, conducting electronic and sms surveys, control of results of marketing campaigns, customer support, organization of delivery of goods to Buyers, realization of raffle prizes among Site Visitors/ Users/ Buyers, control of the satisfaction of the Site Visitor/ User/ Buyer, as well as the quality of services rendered by the Seller.
8.4. Processing of personal data means any action (operation) or a set of actions (operations) performed with or without the use of automated means with personal data, including collection, recording, systematization, accumulation, storage, updating (refreshing, modification), extraction, use, transfer (including transfer to third parties, not excluding cross-border transfer, if the need for it arose in the performance of obligations), depersonalization, blocking, deleting, destruction of personal data.
8.5. The Seller has the right to send informational, including advertising messages to e-mail and cell phone of the User/Buyer with his consent, expressed through the actions, uniquely identifying this subscriber and allowing one to reliably establish his will to receive the message. The User / The Buyer has the right to refuse to receive advertising and other information without explaining the reasons for refusal by informing the Seller of his refusal by telephone or by sending an appropriate application to the Seller’s e-mail address. 8.6. The seller has the right to use the “cookies” technology. Cookies do not contain confidential information. Site Visitor / User / Buyer hereby gives consent to the collection, analysis and use of cookies, including by third parties, for the purpose of compiling statistics and optimizing advertising messages. 8.7. The Seller receives information about the IP address of the Site Visitor. This information is not used to identify the Site Visitor. 8.8. The Seller is not responsible for the information provided by the User / Buyer on the Site in the public form. 8.9. The Seller has the right to record telephone conversations with the User / Buyer. In doing so, the Seller undertakes to: Prevent unauthorized access to information obtained during telephone conversations and/or its transmission to third parties not directly involved in the execution of the Orders in accordance with Art. 4. 16 Federal Law “On information, information technologies and on information protection”. 8.10. The Buyer agrees and allows the Operator and the Operator’s counterparties to process the Buyer’s personal data by using automated database management systems and other software specially developed on behalf of the Operator.
8.11. The Buyer has the right to request from the Operator full information about his personal data, its processing and use, as well as to request the deletion or correction / amendment of incorrect or incomplete personal data. 8.12. The customer may refuse to receive mailouts, receive advertising and other information without explaining the reasons in one of the following ways: • The Client can choose the mailing list settings or opt-out by clicking “Unsubscribe” in the email; • The Customer can contact the Seller’s Customer Service by the phone specified on the https://sayonara.store website in the “Contacts” section. 8.13. The Seller undertakes not to disclose the information received from the Customer. It is not considered a breach for the Seller to provide information to agents and third parties acting on the basis of a contract with the Seller to fulfill of obligations to the Customer.
9. Duration of the Public Offer 9.1. This Public Offer shall enter into force from the moment of its acceptance by the Visitor / Buyer and shall be valid until the revocation of the Public Offer acceptance.
10. Additional conditions 10.1. The Seller is entitled to assign or otherwise transfer its rights and obligations arising from its relationship with the Buyer to third parties. 10.2. The online shop and the services provided may be temporarily, partially or completely unavailable due to maintenance or other works for any other technical reasons. 10.3. The relationship between the User/Buyer and the Seller shall be governed by Russian law. 10.4. In case of questions and claims from the User / Buyer, he may contact the Seller by phone or by other available means. All disputes will be resolved by negotiations, in case of failure to reach an agreement, the dispute will be referred to a judicial authority in accordance with the current legislation of the Russian Federation
10.5. If any provision of this Public Offer shall be made invalid by a court decision, the remainder of this Public Offer shall not be affected thereby.
